We know that you care about your personal data and how it is used, and we want you to trust that The Foundation for Audit Quality (FAQ) is dedicated to protecting the confidentiality and privacy of information entrusted to it. As part of this fundamental obligation, we are committed to the appropriate protection and use of personal information (sometimes referred to as "personally identifiable information" or "PII") that has been collected from you.

Our intent is to collect only the personal information that is provided voluntarily by online visitors so that we can offer information and/or services to those individuals or offer information about services we offer. Who Is Collecting It?

Any personal data provided to or collected by The Foundation for Audit Quality is controlled by The Foundation for Audit Quality, the data controller. References to “FAQ” in this Notice means The Foundation for Audit Quality and any company directly or indirectly owned and/or controlled by The Foundation for Audit Quality that you are interacting with or have a business relationship with.

What Personal Data Is Being Collected?

The Information Technology Act 2000 and its subsequent amendments include extensive definitions for Personal Information and Sensitive Personal Information. For the purposes of this Policy, Personal Information (PI) includes Personally Identifiable Information that is information relating to a natural individual or that could be used directly or indirectly in combination with other information available with Us and is capable of identifying a natural individual. Personal Information does not include information that is anonymous, aggregated, or is no longer identifiable to a natural person.

We and our authorised third parties (Our partners, vendors and entities affiliated with Us) may collect PII pertaining to:

  1. Your identity, demographics and any other information shared by you including but not limited to your name, address, gender, date of birth, occupation, ICAI registration number, designation, title, ICAI membership number, phone number and e-mail id included in the membership application form and other service request forms.
  2. Your communication history with us for support e.g. membership details, event information, etc.

What Purpose Do We Use Your Data For?

FAQ generally collects only the personal information necessary to full-fill your request. Where additional, optional information is sought, you will be notified of this at the point of collection.

We can process personal information, so long as we have a ground under the law to do so. It also requires us to tell you what those grounds are. As a result, when we process your personal information, we will rely on one of the following processing conditions:

  1. Performance of a contract: this is when the processing of your personal information is necessary in order to perform our obligations under a contract.
  2. Legal obligation: this is when we are required to process your personal information in order to comply with a legal obligation, such as keeping records for tax purposes or providing information to a public body or law enforcement agency.
  3. Legitimate interests: we will process information about you where it is in our legitimate interest in running a lawful business to do so in order to further that business, so long as it doesn’t outweigh your interests; or
  4. Your consent: in some cases, we will ask you for specific permission to process some of your personal information, and we will only process your personal information in this way if you agree to us doing so. Examples of the ‘legitimate interests’ referred to above are:

  1. To offer information and/or services to individuals
  2. To process and answer your inquires or to contact you to answer your questions and/ or requests received.
  3. Information on latest updates and articles/publications/discussion papers issued by FAQ
  4. Others- membership and for events and webinars enrolled for
  5. To prevent fraud or criminal activity and to safeguard our IT systems.
  6. To customize an individual’s online experience and improve the performance usability and effectiveness of FAQ’ s online presence.
  7. To meet our corporate and social responsibility obligations.

When we collect and use your personal data for purposes mentioned above or for other purposes, we will inform you before or at the time of collection.

Where appropriate, we will ask for your consent to process the personal data. Where you have given consent for processing activities, you have the right to withdraw your consent at any time.

Who Will It Be Shared With?

We do share personal information with third parties, as necessary for our legitimate professional and business needs, to carry out your requests, organise events and/or as required or permitted by law or professional standards. In addition, FAQ will not transfer your personal information outside India to outside companies.

FAQ will not transfer the personal information you provide to any third parties for their own direct marketing use.

What are Your Rights?

Your rights in relation to your personal data how it is processed. You can exercise these rights at any point. We have provided an overview of these rights below together with what this entails for you.

  1. Access and correction: you have the right to access to that data. This is sometimes called a ‘Subject Access Request’. If we agree that we are obliged to provide personal information to you, we will provide it to you free of charge. Before providing personal information to you, we may ask for proof of identity and sufficient information about your interactions with us that we can locate your personal information. If the information we hold about you is incorrect, you are entitled to ask us to correct any inaccuracies in the personal information.
  2. Object to processing: you have the right to object to us processing your personal information, if we are not entitled to use it anymore.
  3. Other Rights: In addition, you may have rights to have your information deleted if we are keeping it too long, have its processing restricted in certain circumstances and/or to obtain copies of information we hold about you in electronic form.

How Do We Protect Your Personal Data?

The Foundation for Audit Quality (FAQ) takes the security of your personal data very seriously. We take every effort to protect your personal data from misuse, interference, loss, unauthorised access, modification, or disclosure.

To the best of our ability, access to your personal information is limited to those who have a need to know. Those individuals who have access to the data are required to maintain the confidentiality of such information.

How Long Do We Keep Your Personal Data For?

We retain personal data for as long as it is needed to provide our services, stay in contact with you and to comply with applicable laws, regulations and professional obligations that we are subject to and for other legitimate business reasons.

How Do We keep this Notice Up to Date?

The Foundation for Audit Quality (FAQ) may modify this Privacy Notice from time to time to reflect our current privacy practices. When we make changes to this Notice, we will revise the "updated" date at the top of this page. Any changes to the processing of personal information as described in this Privacy Notice affecting you will be communicated to you through an appropriate channel, depending on how we normally communicate with you.
